Bill Proposal Seeks to Provide Free Rides to Ride-Hailing or Taxi App Users When Drivers Do Not Have Change for Cash Payment. This Measure Aims to Ensure Passenger Convenience and Safety, Avoiding Possible Disruptions and Stalemates During the Ride.

The project was rejected by the Commission on Transportation and Communications (CTC), but is being evaluated by the Consumer Defense Commission (CDC) and the Commission on Constitution, Justice, and Citizenship (CCJC).

The representative emphasized that the lack of change causes unnecessary embarrassment, often leading people to make a Pix transfer to pay for the ride or forgoing the change, as the driver does not provide an alternative solution.

The proposal consists of an amendment that replaces law no. 12,587, from January 3, 2012, with the objective of punishing drivers who do not have cash change available.

Bill May Impact the Ride-Hailing Market in Brazil

A legislative proposal could trigger changes in the ride-hailing market in Brazil. Presented by Representative Marcos Soares (União-RJ), PL 4126/23 establishes the obligation for private transportation drivers, such as ride-hailing services like Uber and taxis, to have change available for passengers who choose to pay in cash. According to the proposal, if the driver does not have change, they would be required to provide the service for free.

The representative justifies that the aim of the bill is to protect the consumer against possible abuse situations. The project is still under analysis in the Chamber of Deputies and aims to modify the National Urban Mobility Policy. It is important to highlight that currently, passengers have the option to make payments to ride-hailing drivers through platforms like Pix, not to mention drivers who already provide credit and debit card machines.
