Procon-SP Imposes Historic Fine After Disrespecting the “Do Not Call” Registry
The Banco Pan S/A was fined R$ 13,522,436.17 by Procon-SP for continuing to make telemarketing calls to consumers who were already registered in the “Do Not Call” program. The penalty is considered one of the largest ever imposed by the consumer protection agency in the State of São Paulo, according to the website Correio 24 horas.
What Caused the Fine Against the Bank?
The infraction occurred because the bank continued to call users who had requested a block on commercial calls. The 30-day legal deadline, counted from the registration in the system, was ignored by the financial institution.
According to Procon-SP, this is a serious violation of the right to privacy and the consumer’s peace.
How Was the Penalty Calculated?
The sanction was applied based on three fundamental criteria that guide the accountability of companies in cases of violations of consumer rights. The first criterion considered was the seriousness of the infraction, which evaluated the negative impact of the practices adopted by Banco Pan on the affected consumers.
Next, the economic size of the institution was taken into account, meaning its financial capacity and structure, which directly influence the penalty amount. Finally, the decision was based on the guidelines established by the Consumer Defense Code, which ensures the protection of citizens’ rights against abuses by companies and financial institutions. These three elements were decisive for the imposition of the penalty in a proportional and fair manner.
What Is the “Do Not Call” Program?
The “Do Not Call” program is an initiative of Procon-SP that allows citizens to block unwanted telemarketing calls.
- After registration, companies have 30 days to cease calls.
- The block applies even to companies outside the state.
