Transportation And Travel Committee Approves Innovative Project That Could Modify Rules Of Brazilian Traffic Code, Requiring Photos Of Plates

An project that could revolutionize the way traffic fines are applied is currently under consideration in the Chamber of Deputies.

The proposal, which has already received the green light from the Transportation And Travel Committee, aims to make it mandatory to attach a photo of the plate of the vehicle in the notification of infractions recorded by radars and cameras.

This substitute text for the Bill 2990/24 is awaiting full approval by the Chamber.

Details And Objectives Of The Project

Proposed by the rapporteur, Deputy Gilberto Abramo (Republicanos-MG), the text replaces the original version from Deputy Dayany Bittencourt (União-CE).

The intention is to ensure drivers the right to a full defense in administrative processes by guaranteeing that the image of the plate is an integral part of the process, as argued by the project’s author.

Edits To The Text For Greater Clarity

The rapporteur advocated for edits to the text to improve its precision, opting to require the “image with the vehicle’s plate at the time of the infraction”, instead of an image that captures the entire illegal conduct.

This change aligns the project with the language used in the Resolution 798 of Contran, from 2020, which prioritizes the clear identification of the vehicle involved in the infraction.

The approval of this project could offer greater transparency to the imposition processes, allowing drivers access to concrete evidence in case of disputes.

The measure is still awaiting full validation by the Chamber of Deputies before it becomes a new law.

Finalmente um parlamentar que ecoa fora da caixinha. É uma vergonha o que se tornou essa indústria de multas. Prefeitos já colocam no orçamento anual os valores que esperam arrecadar. Os radares deixou de ter uma função educativa para se tornar uma indústria de receitas financeiras, isso acontece até na PRF. Já ouvi de policiais rodoviários que são sistematicamente cobrados a faturarem multas para cobrir gastos da instituição.
O Brasil é o país vc do descalabro jurídico e social.
