Supreme Federal Court Will Rule on Court-Ordered Payments Next Monday.

The Economic Team Awaits Judgment Regarding the Closure of the Union Budget for 2024, With Expectation and Caution. All Eyes Are Focused on This Crucial Moment That Will Have Significant Impact on the Country’s Financial Scenario.

According to the AGU’s analysis, the financial obligation is not accounted for in the annual reports and will be deferred to the year 2027, when it must be paid.

The person responsible for analyzing the processes is Minister Luiz Fux. The decision will be made in the virtual plenary of the Supreme Federal Court, a format in which the ministers register their votes electronically and there is no in-person discussion. However, one of the ministers may request that the case be transferred for judgment in the physical plenary.

The current payment regime was approved during Jair Bolsonaro’s administration and allowed for the installment payment of precatórios exceeding 60 minimum wages.

The constitutionality of the new regime is being questioned in the Supreme Federal Court in actions filed in 2021 by the PDT and the Brazilian Bar Association (OAB).

According to the Attorney General’s Office (AGU), the regime provides for a progressive increase in expenses and may result in a buildup of unpayable debts. According to the agency, the amount of the debt may reach R$ 250 billion by 2027. This is a serious concern that needs to be considered by the competent authorities.

Judgment of the STF on Precatórios Scheduled for Monday

The Supreme Federal Court (STF) has set Monday (27) as the date for the virtual judgment that will decide on the legality of the current payment system for Precatórios, which are debt titles of the federal government definitively recognized by the Judiciary.

The decision will be awaited with great expectation by the economic team, as it is related to the closure of the Union Budget for the year 2024. Furthermore, the governors of the Northeast are attentive to the case, as the judgment could enable the transfer of approximately R$ 20 billion from the former Fund for Maintenance and Development of Fundamental Education (Fundef) to the states.
