Understand The Proposal That Could Revolutionize Rideshare Services By Requiring Drivers To Have Change For Cash And Granting Free Rides In Case Of Lack Of Change.

Free Rides On Uber And 99? The Debate Surrounding A Draft Law That Directly Affects Rideshare Drivers, Such As Uber And 99, Is Shaking The Legislative Landscape And Generating Diverse Opinions. The Proposal, Which Requires Drivers To Have Change For Cash Payments, Could Completely Change The Dynamics Of Rides. And There’s More: In The Absence Of Change, The Ride Would Be Free For The Passenger. Let’s Understand This Story Better?

What Does The Draft Law Say?

The Draft Law 4126/2023, Authored By Representative Marcos Soares (União-RJ), Aims To Address An Uncomfortable Situation Faced By Many Passengers. According To The Author, It Is Common For Consumers To Be Harmed When Rideshare Drivers Do Not Have Change. In These Situations, Customers Need To Make Transfers Via Pix Or Even Give Up The Amount They Would Have Received Back. For Soares, This Is An Injustice.

The Proposal Suggests That Whenever The Driver Does Not Have Change, The Ride Should Be Free For The Passenger. Although The Goal Is To Ensure More Rights For Consumers, The Draft Does Not Define A Limit For The Amount Of Change. And It Is Exactly Here That Concerns Arise.

Impact On Rideshare Drivers

For Those Who Work As Rideshare Drivers, Such As At Uber Or 99, The Idea Of Offering Free Rides In Case Of Lack Of Change Seems Challenging. Many Point Out That The Logistics Of Keeping Coins And Bills Of Various Denominations Is Complicated, Especially Considering The Scarcity Of Coins In Various Regions Of Brazil. The Lack Of A Clear Limit For The Amount Of Change Could Also Make The Requirement Unfeasible.

Another Point Raised Is The Lack Of Standardization Among The Apps. While Some Drivers Work For More Than One Platform, Such As Uber And 99, Differentiated Rules Can Create Confusion And Hinder The Financial Planning Of These Professionals.

The Rejection In The Transportation Commission

On October 31, 2023, The Transportation Commission Rejected The Proposal. According To Representative Mauricio Marcon (PODE-RS), The Rapporteur Of The Proposal, The Regulation Of Private Transport Is The Responsibility Of The Municipal Public Authority, Not Federal Legislators.

Marcon Also Highlighted That The Lack Of Coins Is A Common Problem In Many Regions, Making The Proposal Difficult To Implement. He Argued That The Measure Would Bring More Hardships Than Solutions, Both For Passengers And Rideshare Drivers.

The Future Of The Proposal

Despite The Initial Rejection, Draft Law 4126/2023 Continues To Move Forward. It Is Now Under Review By The Consumer Defense Commission, Where It Will Be Discussed From A New Perspective. As Of November 1, 2024, The Proposal Is Being Evaluated In A Conclusive Manner, Meaning It May Be Approved Directly By The Relevant Committees Without Going To The Plenary.

The Final Decision Is Still Uncertain, But The Debate Raises Important Questions About Consumer Rights And Driver Obligations. In The Meantime, Passengers And Drivers Are Closely Following The Developments, Awaiting Answers That Balance The Needs Of Both Parties.

How Passengers Can Prepare

Although The Requirement For Change Is Not Yet A Reality, Passengers Can Take Some Steps To Avoid Uncomfortable Situations:

  • Have Exact Change: Whenever Possible, Carry Bills And Coins To Facilitate Payment;
  • Use Digital Options: Most Apps, Such As Uber And 99, Offer Payments Through Pix, Credit, Or Debit Cards. These Options Eliminate The Need For Change;
  • Communicate With The Driver: If You Do Not Have The Exact Amount, Inform The Driver Before Starting The Ride To Avoid Misunderstandings.

What This Means For The App Sector

This Discussion Reflects A Broader Tension Between Consumers And Rideshare Drivers. On One Side, Passengers Seek More Guarantees That They Will Be Treated Fairly. On The Other, Drivers Face Daily Challenges In Balancing Comfort, Safety, And Financial Viability.

Companies Like Uber And 99 Also Play A Crucial Role In This Scenario. They Can Invest In Technological Solutions That Make Payments More Practical, Such As Automatic Discounts For Rides With Change Issues Or Incentives For Drivers Who Keep Bills And Coins Available.

The Proposal For Free Rides At Uber And 99 In Case Of Lack Of Change Raises An Important Question: How To Balance Consumer Rights With The Reality Of Drivers? While The Intention Of The Proposal Is To Protect Passengers, It Is Essential That Any Measure Also Takes Into Account The Difficulties Faced By Those Who Rely On Apps To Work.
