Retired Worker Who Continues Working Keeps Right to Insalubrity Supplement Paid by Employer and Can Accumulate Salary and Pension.

Many workers believe that upon retirement, they lose access to labor benefits if they choose to remain in the job market. But Brazilian legislation and consolidated jurisprudence make it clear: retirement does not eliminate the rights provided in the CLT. Thus, the retiree who continues working still has the right to all payments, including the insalubrity supplement, when performing tasks in conditions harmful to health.

This supplement is paid directly by the employer, not by the INSS, and has a salary nature. This means that it is included in the worker’s monthly remuneration, generating impacts on vacation, 13th salary, and FGTS, even when accumulated with retirement benefits.

What The Law Says About The Insalubrity Supplement

The insalubrity supplement is provided for in the arts. 189 to 192 of the CLT. It is owed to all employees who work exposed to harmful agents, such as chemical products, excessive heat, noise above the limits, or radiation.

The applicable percentages are defined according to the degree of exposure: 10% for minimum degree, 20% for medium degree, and 40% for maximum degree, calculated based on the minimum wage. This right is independent of the worker’s age or their pension status: if there is insalubrity, the employer must pay the supplement.

Thus, the fact that the employee is retired does not revoke the right to the supplement. Retirement generates the pension benefit paid by the INSS, but the active employment contract remains subject to labor laws.

Jurisprudence Confirms Accumulation of Pension and Salary Additions

The Superior Labor Court (TST) and the Superior Court of Justice (STJ) have analyzed the topic several times.

The understanding is unanimous: retired workers who remain or return to the job market can accumulate retirement with the insalubrity or danger supplements paid by the employer.

In a 2024 ruling, the STJ reiterated that these supplements have salary nature and, therefore, are subject to employer social security contributions. This reinforces the typical labor payment character that follows the employee even after retirement.

Moreover, decisions from the TST confirm that the employment relationship does not end with voluntary retirement — only the formal termination of the contract breaks the bond. Therefore, as long as there is an active contract, all rights remain intact.

Difference Between Insalubrity and Special Retirement

It is important not to confuse the insalubrity supplement with special retirement. Special retirement is a pension benefit from the INSS, granted to those who prove prolonged exposure to harmful agents. On the other hand, the insalubrity supplement is a labor payment made by the employer while the contract is in effect.

A retired worker who returns to work in a hazardous environment does not lose retirement, but also does not regain the right to special retirement, as decided by the STF in 2020. What remains is the right to the monthly supplement, specifically to compensate for the activity’s risk.

Impacts for Companies and Workers

For workers, the rule signifies a form of financial security. Many retirees who continue in the job market do so out of necessity to supplement their income. Receiving the insalubrity supplement, along with their salary and pension, represents a way to compensate for the job’s wear.

For companies, the challenge is to redouble their efforts regarding health and safety at work. In addition to the cost of the required supplement, they may be held liable if they do not comply with protection regulations and if harm to the employee’s health is proven.

Experts Reinforce the Understanding

Labor attorney Márcio Túlio Viana explains: “Retirement does not terminate the employment bond. The retired worker remains an employee, and all the rights of the CLT apply, including the insalubrity supplement.”

Meanwhile, labor law professor Alice Monteiro de Barros highlights that “the supplement has an immediate compensatory function. Retirement is a pension benefit, while insalubrity reflects the active contract. There is no incompatibility in receiving both.”

Retirement Does Not Nullify Rights and Justice Protects the Worker

The current understanding is clear: retirement and labor rights go hand in hand. The insalubrity supplement, paid by the employer, can be accumulated with the INSS retirement, as long as the worker remains exposed to harmful conditions while performing their duties.

The message from Justice is direct: those who continue working retain all the rights of the CLT, regardless of their retirement status.

Therefore, companies must prepare to ensure adequate conditions and properly pay the owed amounts, under penalty of being liable in court.
