Bolsonaro wants to show that most of the fuel taxation is not concentrated on federal taxes, but on other taxes that are not under the federal government’s jurisdiction.
The average regional price of fuel at the producer or importer, the reference price used for the ICMS (Tax on Circulation of Goods and Services) charged by the federation units, and the tax amount, in addition to the value of PIS/Cofins and Cide, both charged by the federal government, must be provided.

Additionally, gas stations that practice “promotional rates” linked to loyalty programs must inform consumers of the promotional price, the real price, and the value of the discount on fuels.
Through a note, the General Secretariat of the Presidency of the Republic states that “the measure provides more clarity on the elements that result in the final price and will give insight into the real reasons for price variations” and “strengthens one of the pillars of consumer protection, which is the right to information.”
Gas Stations Across Brazil Will Have 30 Days to Comply with the Decree
Gas stations will have 30 days to comply, so the idea is that it will come into effect during the federal tax exemption period on diesel, between March and April.
The problem is that the double taxation applied to fuels complicates the lives of gas station owners, who rarely know how much they pay in ICMS. The computer systems contracted by merchants only estimate the amount.
