Text Approved by the Administration and Public Service Commission Includes Additional Time on Tests and New Accessibility Guarantees for Candidates with ASD and ADD, Strengthening Equality in Brazilian Public Competitions

The Administration and Public Service Commission (CASP) of the Chamber of Deputies approved the substitute for Bill 4848/23, authored by Deputy Maria Arraes (Solidarity-PE).

The text, reported by Leo Prates (PDT-BA), makes it a crime to charge additional fees, refuse, or cancel enrollment of students with Autism Spectrum Disorder (ASD) in public or private educational institutions. The penalty provided is two to five years of imprisonment, in addition to a fine.

The substitute also incorporates changes previously approved by the Education Commission, which expand the rights guaranteed to individuals with ASD and Attention Deficit Hyperactivity Disorder (ADHD) in the Brazilian Inclusion Law (BIL).

Among the new guarantees are preferential treatment, sign language translation, use of assistive technology resources, and granting extra time for taking exams for competitions and academic activities—provided that prior request and proof of need are submitted.

Initially, the CASP text only provided for an additional hour in public competition tests, but the current version has been expanded to include other forms of accessibility.

According to Leo Prates, the approved measures “promote equality of conditions in public and educational competitions, in accordance with the Constitution, which ensures fundamental rights and prohibits any form of discrimination.”

The project will now proceed for conclusive analysis in the Committee on Constitution, Justice and Citizenship (CCJ). If approved, it will still need to go through the chambers of the House and the Senate before it becomes law.
