The penalty imposed by the Electoral Court on the PT member, for electoral ideological falsehood, is 4 years and 6 months in prison in a semi-open regime. The lawsuit against Haddad arose from an investigation that aimed to identify the use of resources by the contractor UTC in the preparation of material for Haddad's campaign for the city hall in 2012.

In the indictment, electoral promoter Luiz Henrique Dal Poz stated that Haddad “failed to account for values, as well as using disreputable notes to justify expenses”. The amount received from UTC Engenharia, according to the complaint, was R$ 2,6 million.
The amounts would have been delivered by the contractor directly to the printers of Francisco Carlos de Souza, a former state deputy and union leader known in the PT as 'Chico Gordo'.
Francisco revealed that he received the payments, but said that they were not intended for the former mayor's campaign, but for other PT candidates whose names he did not inform the Federal police.
According to the complaint, R$ 3 million would have been negotiated with businessman Ricardo Pessoa, from UTC Engenharia, and later signed for R$ 2,6 million. In addition to the contractor, who is a whistleblower, money changer Alberto Youssef also mentioned the operations in his testimony.
The decision was handed down by Judge Francisco Shintate, 1st Electoral District of São Paulo and will be published on Wednesday, 21, in the Electronic Justice Gazette.
The former mayor was also denounced in the criminal sphere for this same case, involving corruption and money laundering. The 12th Chamber of the Court of Justice of the State of São Paulo, however, blocked the action in February.
Haddad's defense says it will appeal, as the witnesses and documents prove that the declared expenses were presented. In addition, the former mayor argues that the magistrate condemned him for something that the Public Ministry does not accuse him of.
