Without the holiday, the fifth business day would fall on May 6th (Wednesday). With it, the legal payment date is May 7th (Thursday), and those unaware of this may create unnecessary conflict with the employer.

The confusion happens every month that starts with a holiday, but May is especially tricky. Since Labor Day is precisely the celebration of labor rights, the irony of not knowing when the salary falls this month does not go unnoticed. How the count of business days works in May 2026

The rule is simple and applies to most labor calculations: business days are all days from Monday to Saturday that are not national holidays. Sundays and holidays are not included in the count. Applying this rule to May 2026, the result is as follows: May 1st (Friday) is a national holiday and does not count. Saturday, May 2nd, is the first business day of the month.

It is important to note that not all companies follow the 5th business day as the payment date. Some pay on the last business day of the current month, others on the 30th or 25th. The first step is to check with the company’s human resources or finance department if there was any operational problem, such as a banking error, insufficient balance, or registration inconsistency. Often, the delay is not intentional and can be resolved on the same day.

If the company confirms that it did not make the payment within the deadline, the worker has the right to file a complaint with the category’s union or the Ministry of Labor. Delay in salary payment is a labor infraction that can result in a fine for the employer, and in recurring cases, it can justify a request for indirect termination of the employment contract with the right to all severance payments as if the worker had been dismissed without just cause.
