It may seem impossible, but it’s real: a motorcyclist was fined for not wearing a seatbelt in a story that borders on the absurd. The unusual case recently took place in Concórdia do Oeste, a district of Toledo, in western Paraná. This bizarre situation is generating buzz and raising questions about the enforcement of traffic laws in Brazil. Reaction Of The Motorcyclist Fined For Not Wearing Seatbelt

According to the infraction report from the Department of Highways of the State of Minas Gerais (DER-MG), the two-wheeled vehicle that received a traffic fine was circulating on highway MG-184, near the municipality of Alterosa, southern Minas Gerais. The document states that the rider was not wearing a helmet.

The big problem is that the safety equipment does not exist on motorcycles and is also not mandatory for this type of vehicle. Another strange point in the case is that neither the motorcyclist fined for not wearing a seatbelt, Armando Simonatto, nor the motorcycle has ever been in Minas Gerais.

Between the city where Armando lives with his family and the city where the fine was registered, there is a distance of over a thousand kilometers. Even so, the letter with the notification of the traffic fine arrived at his home.

In a report to the G1 portal, the wife of the motorcyclist fined for not wearing a seatbelt says she couldn’t believe what she read after opening the document sent by DER-MG, which stated that her husband had received a fine in the amount of R$ 195.23 and five points on his National Driver’s License (CNH).

Motorcyclist Fined For Not Wearing Seatbelt Will Appeal The Fine

According to Dileta Simonatto, the motorcyclist’s wife, she claims to be a good-humored person and began to laugh at the traffic fine, however, now she will have to go after the authorities to resolve the issue. She points out that the family uses the motorcycle for short distances and soon realized that something was wrong with the story. Her only route is four kilometers per day, during the week, when her husband goes to work. 

He leaves home and goes two kilometers, and at night, he comes back home, another two kilometers. This has been the motorcycle’s route since 2018, it has never left the community. According to Dileta, the inconsistency in the traffic fine raises serious questions about the accuracy and effectiveness of the DER-MG notification system.

However, she recalls the importance of wearing a seatbelt in vehicles where it is a mandatory item. To correct the error, Dileta assures that she will contest the fine, but also raises the possibility of being a victim of a scam or license plate cloning. DER-MG, regarding the motorcyclist fined for not wearing a seatbelt, advised the family to appeal the penalty as provided by the Brazilian Traffic Code (CTB).

“explicar o contexto dessa multa e discutir as possíveis falhas que levaram a esse ‘erro da lei’ “. Não explicou nada. Se já não confiávamos muito, agora desconfiarem de tudo. Esse ano eu recebi 2 multas com cerca de 40 minutos de diferença por avanço de sinal vermelho, na foto eu não avancei o sinal, está bem claro a distância que estou antes do semáforo. Meu advogado escolheu processar o departamento de trânsito de Poços, ao invés de recorrer. Em Minas as coisas parecem da idade da pedra, um carro meu realizou todos os parâmetros legais para constar o combustível GNV, não colocaram no documento, ele veio errado e agora se recusam arrumar. Meu primeiro RG em Minas, ano passado, colocaram um sobrenome na minha mãe que ela nunca teve. Eu já devia desconfiar a minha mãe sendo mineira e em um de seus documentos chamar Bernardete, como um R a mais e noutro ter o sobrenome Camargo no lugar de Carvalho.
