Proposal by Mara Gabrilli, Reported by Paulo Paim, Guarantees Immigrants Residing in Brazil the Right to an Emergency Aid of R$ 400 and Non-Discrimination Service.
The Commission on Social Affairs (CAS) of the Senate approved this Wednesday (8) Bill 2,425/2020, which guarantees the payment of an emergency aid of R$ 400 to immigrants residing in Brazil in situations of vulnerability.
The proposal, authored by Senator Mara Gabrilli (PSD-SP), received a favorable opinion from the rapporteur, Senator Paulo Paim (PT-RS), and now moves on for analysis in the Chamber of Deputies.
According to the text, the benefit will be paid by the federal government to foreigners living in the country and facing economic difficulties.

The project amends the Organic Law of Social Assistance (LOAS – Law 8,742, of 1993) to ensure that immigrants have access to social assistance without discrimination based on nationality or migratory status.
Guarantee of Access and Equity
In his opinion, Paulo Paim emphasized that the project reinforces the understanding of the Federal Supreme Court (STF), according to which the lack of regular documentation cannot prevent vulnerable individuals from accessing social programs.
The senator highlighted that the measure avoids regional disparities, ensuring that the assistance policy is applied uniformly throughout the country.
For him, public policies need to keep pace with the changes caused by migratory flows. The parliamentarian reminded that the Ministry of Social Development expanded services geared toward immigrants, especially after the increase in the arrival of Haitians in 2010, offering welcome, community coexistence, and support for autonomy.
Paim also mentioned the work of the Reference Center for Immigrant and Refugee Assistance and the Operation Welcome, which since 2018 has been assisting Venezuelans with housing, documentation, and social integration.
These initiatives, according to the senator, reinforce the importance of consolidating the right of immigrants to social assistance and ensuring the universal social protection provided for in Brazilian legislation.
