According to Reporter in Brasília Flávia Maia from Jota Pro Poder, the appeal against the decision of Minister Alexandre de Moraes, which overturned a billion-dollar labor condemnation involving the Brazilian oil giant Petrobras, will be judged starting on February 11 by the 1st Panel of the Supreme Federal Court (STF).

Labor Lawsuit Against Petrobras Could Cause a R$ 47 Billion Impact on the State-Owned Company’s Coffers
The lawsuit that will be judged this month by the STF concerns the calculation of remuneration established in a collective agreement from 2007, called Minimum Remuneration by Level and Regime (RMNR), which had been applied by the company. In 2018, Petrobras lost this same lawsuit by 13 votes to 12 in the plenary of the Superior Labor Court, which deemed the company’s calculation irregular.
In the Supreme Court, Petrobras achieved victory because Minister Alexandre de Moraes, the rapporteur of the appeal, understood that the agreement did not eliminate or reduce labor rights, nor was there any violation of the principle of equality among the company’s workers.

The judgment, which begins on February 11 and extends until February 18, will take place in a virtual plenary. It will be up to the panel to uphold or overturn the rapporteur’s decision. The 1st Panel consists of Ministers Rosa Weber and Carmen Lúcia and Ministers Dias Toffoli, Luís Roberto Barroso, and Alexandre de Moraes.
Currently, this is the largest labor lawsuit against Petrobras and, according to the oil company, it could cause an impact of R$ 47 billion on the state-owned company’s coffers. There are more than 7,000 individual lawsuits involving Petrobras on this topic in the judiciary, in addition to 47 collective actions.
