Imagine waking up to find more than R$ 318 thousand deposited in your bank account, with no notice, no explanation. This is exactly what happened to a woman in Goiás in 2023. The money came from a transfer error via Pix, and instead of contacting the bank or the sender, she withdrew part of the amount and refused to return the remainder. The real case, officially registered by the Civil Police of the State of Goiás, sparked an intense debate about the limits of good faith, failures in the digital financial system, and the role of justice in the face of large-scale banking errors. Here you will understand what happened, what the law states, how the erroneous Pix facilitated this type of mistake, and what the legal risks are for those who receive undue amounts and refuse to return them.

Understand the Case: Erroneous Pix of R$ 318 Thousand

The case came to light in March 2023, in Trindade (GO), when a company made a Pix transfer of R$ 318,600.00 to a woman’s account due to a typographical error in the Pix key.

Upon realizing the mistake, the person responsible for the transfer tried to contact the beneficiary but did not receive a response. He then contacted the financial institution and subsequently filed a police report.

According to the Civil Police, the woman withdrew part of the money and used another part for personal purchases. Even after being formally notified about the mistake, she claimed she would not return the amount, stating that the money was already being used to pay off debts.

What Does the Law Say About Erroneous Pix Cases?

Receipt of Undue Amounts Does Not Create Ownership Rights

The Brazilian Civil Code is clear about the return of amounts received by mistake. Article 876 states:

“Anyone who receives what is not due to them is obliged to return it; an obligation that falls on the one who received something undue, aware of the mistake, or on the one to whom the payment was made by mistake.”

In other words, even if the money was mistakenly deposited into the account, possession does not generate rights over the amount. On the contrary, keeping the amount constitutes illicit enrichment, subject to legal action and criminal liability.

Police Consider It a Crime to Keep Erroneous Pix

Based on the investigations, the Civil Police of Goiás stated that the woman’s actions constitute, in theory, the crime of appropriation of a found or undue item, as provided for in Article 169 of the Penal Code, which states:

“Appropriating oneself of someone else’s property that came into one’s possession by mistake, chance, or force of nature.”
Punishment: detention from one month to one year or a fine.

Additionally, if there are indications of bad faith or concealment of assets, the crime can be interpreted as embezzlement, with a harsher penalty.

The woman was summoned to provide testimony, and the case was forwarded to the Public Ministry, which is considering filing charges with the court.

Why Do Errors in Pix Still Happen?

The Pix, an instant payment system launched by the Central Bank in 2020, revolutionized the way money is transferred in Brazil. However, human errors such as incorrect typing of the Pix key, wrong selection in the transaction history, or mistaken visual confirmation still frequently occur.

According to data from the Central Bank itself:

  • In 2023, over 17 thousand cases of complaints involving erroneous Pix were recorded;
  • The majority of errors occur due to incorrect typing of the alphanumeric key;
  • There is still confusion among users about how to reverse the transferred amount.

Is It Possible to Reverse an Erroneous Pix?

Yes, but with Limitations.

According to the Central Bank, Pix is irreversible, meaning that once authorized and confirmed, the amount cannot be unilaterally canceled. However, there are alternatives provided in the case of a proven error:

  • Direct Request to the Receiver: the most common and effective, but depends on the good faith of the other party.
  • Dispute Opening via Issuing Bank: the bank can attempt to block the amount as long as it is still available in the receiver’s account.
  • Legal Action: when there is no voluntary return, it is possible to turn to the courts to force the return of the amount.
  • Filing a Police Report: especially when there are signs of bad faith.

Similar Cases Have Occurred

The case of the woman in Goiás is not unique. Here are other real cases that caught attention:

  • São Paulo (2021): A man accidentally received R$ 500 thousand, spent it on cars, and was ordered to return the entire amount with interest and face charges of embezzlement.
  • Rio de Janeiro (2022): A young person who received Pix of R$ 140 thousand tried to transfer the amount to several accounts but had the amounts blocked by the judiciary.
  • Paraná (2020): A retiree received R$ 43 thousand and immediately informed the bank, being publicly commended for his actions.

These examples show that, in addition to being illegal, using money from an undue source can result in severe civil and criminal consequences.

What Happens if the Person Spends the Money Before Justice Acts?

Even if the money has already been withdrawn or spent, the courts may determine:

  • Full Return of the Amount with monetary correction;
  • Blocking of assets, vehicles, or bank accounts;
  • Payment of compensation for material and moral damages;
  • Criminal Conviction for embezzlement.

In some cases, the accused may be listed in delinquent registries and face execution actions that compromise their financial life for years.

Experts Advise: What to Do Upon Receiving an Erroneous Pix

The Procon and the Central Bank recommend the following actions if an unknown amount enters your account:

  • Do not move the amount;
  • Check with your bank about the source of the Pix;
  • Access your detailed statement and take screenshots;
  • Immediately inform the bank or the issuing institution;
  • Do not attempt to circumvent the system or “buy time”;
  • If in doubt, voluntarily file a police report.

These actions demonstrate good faith, which is relevant in any judicial analysis.

The case generated thousands of comments on social media. Many internet users defended the woman with statements like:

  • “If it fell into her account, the mistake was the other party’s.”
  • “The bank should bear the loss.”
  • “This is a gift from God.”

On the other hand, legal experts point out that ethics and legality must prevail, since keeping an undue amount is a crime.

Furthermore, if everyone accepted such behavior, the financial system would lose credibility, which would negatively affect the entire population.

What Do Banks Say?

The financial institutions involved are required to cooperate with investigations and generally provide support to clients who mistakenly sent amounts. However, reimbursement is not automatic, especially if the amount has already been transferred to other accounts or withdrawn.

The Central Bank of Brazil clarifies that, in 2024, new Pix functionalities have allowed:

  • Request for Automatic Refund (Pix Refund);
  • Temporary Precautionary Blocking in suspicious cases;
  • Fraud and Error Prevention Mechanisms.

Still, the ultimate responsibility lies with the user, who must carefully verify the details before confirming a transfer.
