STF Decree Arrives as ‘Unforgivable’ Traffic Law That Generates Fines of Nearly R$ 3,000 for Common Driver Behavior, Check It Out!

A New Decree by the Supreme Court Is Being Compared to an Unforgiving Traffic Law. Understand How This Decree Will Work That May Impose Severe Traffic Fines, Significantly Impacting the Wallets of Brazilians.

A traffic fine is undoubtedly one of the biggest challenges faced by drivers. No one leaves home intending to be penalized, especially with a fine that weighs on their wallet and leaves the vehicle in an irregular situation until the penalty is paid. Therefore, it is essential that drivers are always attentive to traffic regulations, as they undergo constant reformulations and must be complied with rigorously. Now, a new decree by the Supreme Court introduces a traffic law that imposes fines for infractions common among drivers, generating great concern.

Understand How the Supreme Court Decree for the Traffic Fine Works

It happens that the Supreme Court validated the rule of the Brazilian Traffic Code (CTB) which establishes the application of fines, the retention of the National Driver’s License (CNH), and even the seizure of the document for a year for drivers who violate the new regulations.

It is worth mentioning that the traffic fine is applied to those who refuse to take a breathalyzer test, clinical exams, or expert evaluations aimed at assessing any influence of alcohol, or any other psychoactive substance. The panel maintained the prohibition of selling alcoholic beverages along federal highways.

According to the Supreme Court Decree, the new traffic law does not violate the Constitution, and the legal provision for imposing administrative sanctions on drivers of motor vehicles who refuse to undergo tests, clinical exams, or expert evaluations aimed at assessing the influence of alcohol or another psychoactive substance (Article 165-A and Article 277, paragraphs 2 and 3, all of the Brazilian Traffic Code).

Articles 277 and 165-A of the CTB stipulate that the driver of a motor vehicle subjected to traffic inspection may be subjected to a test, clinical exam, expert evaluation, or other procedures that, through technical or scientific means, in accordance with the rules established by Contran, certify the influence of alcohol or another psychoactive substance that causes dependence, with refusal being a serious infraction.

An Average of 56 Drivers Were Fined for Traffic Violations Per Day in the First Quarter of This Year

Thus, it can be inferred that the decree from the Supreme Court arrives as an unforgiving traffic law to punish drivers who do not comply with the regulations as they really need to be followed. Therefore, with the new traffic law, in addition to greater control over Brazilian traffic, the safety of all is also guaranteed. 

This year, from January to March, on average, 56 drivers ended up being fined per day for driving under the influence of alcohol, totaling 5,106 such violations, according to media reports.

It is important to mention that there is no tolerance for the test, and for some years now, Brazil has adopted a zero-tolerance policy regarding the crime of drunk driving. This means that no one should drive after ingesting any amount of alcohol. 

The infraction is considered serious, and the legislation specifies a traffic fine of R$ 2,934.70, as in this case, the Article 165 provides a multiplier factor of 3.5 or 10 times in the case of serious infractions. This factor is established according to the risk posed by the driver when violating the law.

Another Traffic Law May Change Soon

A new bill under consideration in the Chamber of Deputies seeks to amend the Brazilian Traffic Code. The proposal is by Deputy Clodoaldo Magalhães and defines as a serious infraction the act of making dangerous overtakes and driving irresponsibly, in such a way that it puts people’s lives at risk.

The text also proposes the suspension of the National Driver’s License for 12 months for those caught in any of the aforementioned acts. The proposal clarifies that a dangerous overtaking or reckless driving will be considered “any maneuver in disagreement” with the already existing regulations in the Brazilian Traffic Code, which puts people’s lives at risk.
