Elderly Worker Who Lived as a Domestic Worker Since the Age of 4 in Porto Alegre Is Granted Inheritance Rights After Court Recognizes Affective Parenthood.
The Court of Rio Grande do Sul recognized the affective parenthood of an elderly worker who lived in a family home since the age of 4 in Porto Alegre. The recognition assures the woman the right to an unexpected inheritance, after decades dedicated to life in the home where she grew up and worked. The couple who has now been legally considered as parents has already passed away, but their names will be included on the elderly woman’s birth certificate.
From Domestic Work to Family Life
The case began with a complaint submitted to the Labor Public Prosecutor’s Office (MPT-RS), which pointed to a situation of domestic slave labor. The elderly woman, however, refused to leave the residence. According to the Federal Public Defender’s Office (DPU), she has always recognized herself as part of the family and expressed a sense of belonging to the place.
Given her history and advanced age, the DPU filed a lawsuit to ensure family ties and inheritance rights.

Judicial Decision and Justification
The ruling was issued by Judge Carmen Lúcia Santos da Fontoura of the 1st Family Court of Porto Alegre. She ordered that the registry office record the affective parenthood on the elderly woman’s birth certificate based on Article 1.593 of the Civil Code.
According to the magistrate, the decision was of an exceptional nature, as the woman grew up, worked, and aged in the same house, emotionally connected to the deceased couple.
Public defender Patrícia de Mello Sanfelici Fleischmann explained that the request aimed to protect the elderly woman without causing new trauma:
“The only way we found to protect her was through the adoption request, recognizing the family bond she has always experienced, but without the corresponding legal rights. Now, those rights have been assured.”
Guaranteed Rights
With the decision, the elderly woman is now entitled to the inheritance left by the couple, as well as the official recognition of the affective bond built throughout her life.
This is a rare case of judicial recognition of post-mortem affective parenthood, in which the bond goes beyond affection and guarantees property effects.
Domestic Work and Vulnerability
Organizations that advocate for workers highlight that similar situations are not uncommon in Brazil, where children and adolescents, especially in past decades, were incorporated into affluent family homes, often without formal labor rights or fair remuneration.
According to the MPT, this type of practice can configure as work analogous to slavery. Even though in this specific case the affective bond prevailed, the situation exposes the thin line between domestic exploitation and family inclusion.
