Even with Authorization from the Court of Minas Gerais, the Company Claims It Will Keep the Factory Construction Suspended and Is in Dialogue with Environmental Agencies
The brewery Heineken obtained a preliminary injunction (temporary decision) in the Court of Minas Gerais to resume construction of its brewery in Pedro Leopoldo, in the Greater Belo Horizonte area. Release to Continue the Construction of the Factory
The injunction to allow the continuation of the factory construction was granted on Wednesday morning (10/06) by the 12th Federal Civil and Agrarian Court of SJMG (Judicial Section of Minas Gerais), following a writ of amparo filed by the brewery.
In the ruling, Judge Mário de Paula Franco Júnior concluded that ICMBio does not have the authority to discuss the granting of the environmental license that was granted by Semad (State Secretary for the Environment of Minas Gerais) in August 2021. At the time of the embargo, the agency stated that it found no obstacles to the issuance of the authorization. The judge also stated that Heineken complied with all procedures and has an environmental license issued by a competent agency to build the factory on site. Therefore, the company would have the right to proceed with the construction.

At the End of September, the Works Were Halted
The Chico Mendes Institute for Biodiversity Conservation (ICMBio) halted the area where the Heineken brewery would operate in Pedro Leopoldo, in the Metropolitan Region of Belo Horizonte, on 09/21. The venture, which aims to produce 760 million liters per year, would cause damage to the area where the most affected human fossil in the Americas, known as “Luzia,” was found.
The threat of burying the complex of caves and caverns where the oldest skeleton in South America—the skull of Luzia—was discovered led ICMBio (Chico Mendes Institute for Biodiversity Conservation) to suspend the construction of a Heineken brewery in Pedro Leopoldo, in the metropolitan area of Belo Horizonte. The environmental agency also sent a letter to the Minas Gerais government, which had already granted the preliminary license for the construction, and imposed two fines on the company totaling R$ 83,000.
The construction of the factory was even used by Governor Romeu Zema (Novo) as a political banner. When he announced the deal with the brewery, the politician posted a video on social media praising the attraction of an investment of R$ 1.8 billion for the state. One of Zema’s secretaries highlighted the government’s “dynamism” in convincing Heineken to build the factory in Pedro Leopoldo, located 40 kilometers from Belo Horizonte, in Minas Gerais.
Some Details About the New Heineken Factory in Minas Gerais
This unit is the first Heineken factory entirely built in Brazil; all other 15 production units belonging to the multinational in the country were acquired during the purchase of Brasil Kirin in 2017, which in turn owned the breweries that were once part of Schincariol. Six months after the official announcement of the establishment of a Heineken factory in the state, the company is awaiting the issuance of licenses from the State Secretary for the Environment and Sustainable Development of Minas Gerais.
In May, it was reported that the Heineken brewery had already acquired a piece of land from the Development Bank of Minas Gerais (BDMG), purchased an area from Precon Engenharia, and was negotiating others in the vicinity. At the time, the company did not comment on the matter, but the report accessed documents and information that indicate the construction will take place near where the venture was supposed to be. A source related to the negotiations, who requested to remain anonymous, detailed that the brewery’s factory installation will occur on a junction of four plots of land.
