A New Traffic Fine Starts This Week, Specifically Next Wednesday (24), That Will Cost The Offending Driver A Penalty Of Over R$ 1,400.
According to the Detran, this measure was defined by the agency in 2023 with the aim of reinforcing safety on Brazilian roads and streets.
According to the agency, traffic fines are one of the tools aimed at ensuring safety on the roads by regulating driver behavior and, consequently, punishing drivers who commit infractions.
What Is The New Traffic Fine?
This new fine addressed in the Click Petróleo e Gás article, which will take effect on the next 24th, is intended to penalize drivers caught operating freight, towing, or passenger vehicles with a toxicological examination expired for more than 30 days.

According to the legislation, the infraction in question is considered very serious, with a penalty set at R$ 1,467.35. However, it is a mistake to think that the offender will be penalized only financially. This is because, in addition to the fine, the flagged driver will also accumulate seven points on their National Driver’s License (CNH).
The Purpose Of This New Penalty
According to information from Detran, this new penalty aims to increase traffic safety, as the toxicological examination is mandatory for professional drivers. This examination checks for the presence of psychoactive substances in the driver’s system, such as alcohol, illegal drugs, and controlled medications.
According to Detran, this concern arises in light of a survey conducted by the Ministry of Health, which found that the use of drugs and alcohol is one of the main risk factors for traffic accidents in Brazil – according to the ministry, the use of these substances is responsible for about 20% of accidents, that is, one-fifth of the tragedies recorded on Brazilian roads.
Understand How To Take The Toxicological Exam
It has become clear that taking the exam will be crucial, as it will help avoid a heavy traffic fine and also the accumulation of points on the driver’s license. In this sense, it is important to highlight that the driver interested in taking the exam and avoiding the risk of being penalized should seek a clinic accredited by the National Department of Traffic (Denatran).
According to the information, the biological material used for the exam can be urine or hair, with the test result available within up to 15 business days. Today, the law establishes that the frequency with which the toxicological exam must be carried out varies according to the driver’s age.
In this regard, for drivers aged between 50 and 70, the exam must be done every five years. On the other hand, for drivers over 70 years old, the interval is reduced to three years.
I Got The Fine. Can I Appeal?
Let’s assume you read this article, but still ended up receiving the fine. The question remains: can I appeal? The answer is yes, as there is a process to appeal the imposition.
Thus, upon receiving the traffic fine, the offender must identify the traffic agency that issued the fine, check the deadline for submitting the appeal, and:
- Prepare a substantiated appeal, stating the reasons why they consider the fine unjust;
- Submit the appeal to the competent agency within the established time frame;
- And finally, wait for the analysis and outcome of the appeal.
