New List of Hazardous Professions Guarantees Retirement From 55 Years Old. Change in Rules Expands Protection for At-Risk Workers and Defines New Minimum Age Requirements.
The new list of hazardous professions guarantees retirement from 55 years old, reinforcing the rights of those who work daily in high-risk environments. The measure, already in effect, recognizes the impact of continuous exposure to harmful agents and seeks to offer security and financial relief to thousands of Brazilians.
According to INSS, the update follows the logic of special retirement, which considers the accelerated wear of health for these professionals. Now, in addition to the contribution time, the minimum age also becomes mandatory, which brings important changes to the routine of those who are close to retiring.
Who Is Entitled to Special Retirement
The new list of hazardous professions guarantees retirement from 55 years old for workers exposed to high risks, such as those working in underground mining or in permanent contact with highly harmful agents. This group includes categories such as:
-
Correios become the state-owned company with the largest debt guaranteed by the Treasury, concentrating R$ 10 billion in guarantees, and leaving behind Eletronuclear and Eletrobrás in a multi-billion ranking.
-
Serasa reports a record 82.8 million defaulters in Brazil, reveals R$ 557 billion in accumulated debts, and exposes the size of the crisis that already affects more than half of the population.
-
US doesn’t want Brazilian beef: Trump administration opens investigation against JBS, Tyson, Cargill and National Beef after beef prices soared and companies came to control 85% of bovine processing in the United States
-
The Batista brothers, who built the largest meatpacker on the planet with JBS, also command a little-known branch on the coast of Santa Catarina. Wesley and Joesley operate the activities of the Itajaí port complex through a company that moves millions of tons and almost no one associates with their surname.
- Crusher
- Rock Loader
- Excavator Operator
- Shock Worker
- Underground Miners
- Operator of Underground Rock Crusher
- Rock Driller in Caves
For these cases, the rule requires 15 years of profession combined with the minimum age of 55 years. This combination seeks to balance the need to protect the worker’s health with the sustainability of the social security system.
How Special Retirement Works
Special retirement is aimed at professionals who work under hazardous or dangerous conditions, reducing the necessary contribution time. The logic is simple: the higher the risk, the less the time requirement should be in activity.
However, after the 2019 Pension Reform, there were significant changes. Now, in addition to the minimum exposure time, it is also necessary to meet the minimum age, which varies according to the risk level of the profession. This ensures better control over requests and preserves the stability of the system.
What Are the Age and Contribution Time Requirements
The update brought different criteria for each risk level. Here’s how the rules are now:
- Low Risk: 25 years of profession + minimum age of 60 years.
- Medium Risk: 20 years of profession + minimum age of 58 years (includes those working with asbestos and underground mining in remote areas).
- High Risk: 15 years of profession + minimum age of 55 years (mainly for underground mining).
These parameters reinforce that the new list of hazardous professions guarantees retirement from 55 years old only in cases of greater exposure, recognizing the severity of the conditions faced daily.
Why the Minimum Age Became Mandatory
The goal of the change is to balance labor rights and the sustainability of the system. Before the reform, it was possible to retire solely based on contribution time, which led to early requests and financial impact on social security.
Now, by including the minimum age, the legislation ensures that the benefit continues to serve those who truly face early health wear, but without compromising resources allocated to other insured individuals.
Is It Worth Applying for Special Retirement?
For those exposed to hazardous conditions daily, the benefit represents a necessary relief and a way to preserve health. However, social security specialists recommend evaluating on a case-by-case basis, especially with the support of lawyers or unions, as proving the risk conditions requires documents such as the Professional Profile for Social Security (PPP) provided by the company.
In many cases, special retirement may represent the early end to a hard-working journey, but it also requires attention to the benefit calculation, which may be lower than expected if there are no additional contributions.
The new list of hazardous professions guarantees retirement from 55 years old and reinforces the importance of protecting workers who operate in high-risk environments. Although the rules bring advances, they also require planning and information so that each professional knows how to secure their rights without surprises.
And you, do you think the minimum age requirement is fair or should it be more flexible for certain categories? Do you know someone who is awaiting special retirement? Share your opinion in the comments.
