Of The Blocks Offered In The Pre-Notice, Agate, Aquamarine, Emerald, Jade, Tourmaline, And Tupinambá Were Scheduled To Be Offered In The 7th And 8th Production Sharing Rounds In The Santos Basin
ANP published the pre-notice and contract drafts on February 22, outlining the rules for the auction of 11 blocks located in the pre-salt area, in the Permanent Production Sharing Offering (OPP). A public consultation on the documents was also opened, with a public hearing scheduled for March 25.

Of the blocks offered in the pre-notice, Agate, Aquamarine, Emerald, Jade, Tourmaline, and Tupinambá were scheduled to be offered in the 7th and 8th production sharing rounds in the Santos Basin. The others were not awarded in production sharing auction rounds held by ANP: Itaimbezinho (4th Production Sharing Round, Campos Basin), North of Brava (6th Production Sharing Round, Campos Basin), Boomerang, Cruzeiro do Sul, and Southwest of Sagittarius (6th Production Sharing Round, Santos Basin).

The Permanent Offering Was Exclusively Conducted Under A Concession Contracting Regime, Not Including The Possibility Of Including Pre-Salt Areas
The Permanent Offering is originally a format for bidding for granting exploration and production contracts for exploratory blocks and areas with marginal accumulations for exploration or rehabilitation and production of oil and natural gas. In this format, there is a continuous offering of exploratory blocks and areas with marginal accumulations located in any terrestrial or maritime basins.
Until December 2021, the Permanent Offering was conducted exclusively under a concession contracting regime, not allowing for the inclusion of pre-salt areas or those considered strategic areas, under Law No. 12,351/2010, whose legal contracting regime is production sharing.
This limitation, however, was overcome with the publication on 24/12/2021 of CNPE Resolution No. 27/202, which establishes that fields or blocks in the Pre-salt Polygon or in strategic areas may be bid in the Permanent Offering system upon specific determination by CNPE, defining the parameters to be adopted for each field or block.
On 5/1/2022, CNPE Resolution No. 26/2021 was published, authorizing the bidding of 11 blocks in the Permanent Production Sharing Offering (OPP) system, under the production sharing regime, and approving the technical and economic parameters of the bidding.
The exploratory blocks to be offered in the Permanent Production Sharing Offering (OPP) are not related to those offered in the 3rd Cycle of Permanent Concession Offering (OPC), which is currently underway and has a public session for bid presentations scheduled for 13/04.
