According to the MPF, three of his aides and three former executives of the Odebrecht group are also involved in the indictment. The accusation includes ten improper payments totaling R$ 1.440 million as a counterpart for the Municipality not to create obstacles for the public-private partnership with Odebrecht Ambiental during the term that began in 2013.
The MPF’s investigation in the 2nd Region (RJ/ES) was based on corroboration and revelations from executives of the Odebrecht group who were complicit in the scheme and became collaborators of Justice – including the former president of Odebrecht Ambiental who authorized the improper payments. In addition to the mayor, the MPF indicted Jean Vieira de Lima (Municipality Prosecutor), Marcos André Riscado de Brito (former Controller in Macaé), Welton Carlos Arantes Vasconi (intermediary for Dr. Aluízio), and three former executives of Odebrecht: Fernando Luiz Ayres da Cunha Santos Reis (former president of Odebrecht Ambiental), Renato Amaury de Medeiros (former director of Odebrecht Ambiental), and Fernando Fernandes Meias Bessa (former director of Odebrecht Ambiental/Macaé).

The TRF-2 authorized the lifting of telematic secrecy, and thus, the MPF proved, for example, that one of the mayor’s couriers attended the designated address for the delivery of R$ 270 thousand in June 2014.
At the end of the mayor’s term, the criminal action against the four accused will be forwarded to the Federal Court in Macaé, which will assess whether to accept the indictment, making them defendants and initiating the process.
“The payments of bribes to the mayor were closely related to the regular exercise of the contract, since, once ceased, due to various factors, including the beginning of Operation Car Wash in 2014, the company had to resort to the Judiciary to receive the amounts it is entitled to under the contract established with the Municipality,” said the Regional Prosecutor of the Republic Carlos Alberto Aguiar, a member of the Criminal Core for Combating Corruption (NCCC) of the MPF in the 2nd Region.
