On the afternoon of this Thursday, September 12, the final report of the Parliamentary Commission of Inquiry (CPI) of the Legislative Assembly of Minas Gerais was released, which investigates the collapse of the Vale dam in Brumadinho, calling for the indictment of the company’s president at the time of the tragedy, Fábio Schvartsman, and the management of the Brazilian multinational for homicide with eventual intent, assuming the risk of killing 270 times, the number of dead and missing from the disaster that occurred on January 25, 2019.
The text was read in session and unanimously approved. In total, there were 13 individuals who had the request for indictment for eventual qualified homicide: two from TUV Sud and 11 from Vale.

The report states that Vale knew that the dam operated at a safety factor below that required by international industry standards. According to the CPI, the dam’s safety factor was 1.09, while the minimum accepted was 1.30.
The text also mentions that the mining company did not give the “due attention” to the water entry in the upstream dam near the reservoir.
“There was deliberate blindness by Vale”, stated the CPI rapporteur, deputy André Quintão (PT), during the reading of the report.
According to the document, there was also “conscious and voluntary omission of safety measures” on the part of Vale and Tüv Süd, the consulting firm that issued the stability report of the dam.
The CPI lasted about six months. The report is approximately 340 pages long. There were 31 meetings held and 149 testimonies given.
The request for indictment will be sent to the Public Prosecutor’s Office of the State of Minas Gerais (MPMG), which will decide whether to forward the request to the judiciary. Vale has not yet commented on the report.
So far, 249 deaths have been confirmed from the dam collapse. Another 21 people are missing.
