The Chamber of Deputies approved on Friday (05) a groundbreaking bill that expands unemployment insurance for Individual Microentrepreneurs (MEIs) who did not earn income. Unemployment insurance has always been a crucial pillar of Social Security in Brazil, providing temporary income for involuntarily laid-off workers while they seek new employment in the market. Approval of the Bill
The bill 323/24, authored by Deputy Jonas Donizette (PSB-SP), was approved by the Committee on Industry, Commerce and Services of the Chamber of Deputies. Initially, the proposal excluded participants of business partnerships, but a subsequent amendment extended the benefit to this group as well.
The text now goes for analysis in the Committees on Labor, Finance and Taxation, Constitution and Justice, and Citizenship. After approval in these instances, the bill will be forwarded to the Federal Senate and, if approved, will proceed to presidential sanction. Learn more about the bill.
Requirements for MEIs to Access Unemployment Insurance
To access unemployment insurance, MEIs must meet certain criteria. First, it is necessary to prove a minimum contribution period, which varies from 6 to 12 months, depending on the number of previous claims.
Additionally, applicants must provide their Individual Income Tax Return (IRPF), proving the absence of sufficient own income for subsistence.
It is also required to prove that they are not receiving ongoing social security benefits, except for accident assistance, supplementary assistance, and permanency allowance.
Benefit Amounts and Duration
The amounts and duration of unemployment insurance for MEIs will follow the same rules applied to formal workers. The benefit will be calculated based on the average of the last three contribution salaries, limited to the ceiling of R$ 2,230.00 (2023 value).
As for duration, unemployment insurance will be granted for a period of 3 to 5 monthly installments, depending on the contribution time prior to dismissal. To receive subsequent installments, the beneficiary must prove the maintenance of eligibility conditions.
Procedures for Application
Once the new law comes into effect, MEIs will be able to apply for unemployment insurance by following the steps below:
- Gather Required Documentation: Prepare all the required documents, such as proof of registration as an MEI, income tax declarations, proof of previous income, and personal documents.
- Schedule an Appointment: Applications must be made in person at the Ministry of Labor and Employment offices or through the available electronic channels.
- Fill Out Forms: During the appointment, it will be necessary to fill out specific forms for the benefit application, providing detailed information about professional and financial situation.
- Prove Requirements: Present evidence that the requirements established by the new legislation have been met, such as the minimum contribution period and the absence of other income sources.
- Monitor Processing: After submitting the documentation, wait for the processing and analysis of the request by the competent authorities.
- Receive Benefit: If approved, unemployment insurance will be deposited monthly into the bank account indicated by the beneficiary, according to the number of installments they are entitled to.
