Federal Court Decision Considers Trump’s Tariffs Illegal, But Keeps Them In Effect During The Process, Deepening Confusion Among Exporters, Importers, And Investors.
A legal standoff over Trump’s tariffs is causing great confusion in the international landscape. Exporters, importers, and investors are facing uncertainties after a federal appellate court ruled that the tariffs imposed by President Donald Trump are illegal. However, despite the government’s defeat, the judges determined that the charges will remain in effect while the legal process unfolds.
Contradictory Judicial Decision Deepens Confusion
The decision deepens instability in trade and could impact trillions of dollars in global transactions. On Friday night (29), a panel of judges in Washington decided, by 7 votes to 4, that the taxes violated the International Emergency Economic Powers Act (IEEPA). According to the magistrates, the law was never intended to authorize tariffs.
Despite declaring the illegality, the charge of Trump’s tariffs was upheld. This creates a complex and contradictory scenario for all involved in international trade, who do not know how to proceed.

The Uncertain Future of U.S. Trade Relations
The future of the tariffs remains undefined. The Trump administration may appeal directly to the Supreme Court. Another possibility is to wait for a reassessment of the case by the International Trade Court.
“Our trading partners must be stunned and confused“, stated Wendy Cutler, former U.S. trade negotiator. She highlighted that many countries have already signed preliminary agreements or are still in the negotiation phase, and the current legal uncertainty complicates the entire scenario.
Direct Impact on Companies, Consumers, and Agreements
A potential final decision that invalidates the tariffs could have drastic consequences. Commercial agreements already established could be dismantled. Additionally, Washington could be forced to refund hundreds of billions of dollars in taxes collected in recent months.
The decision was celebrated by small businesses that challenged the taxes. Elana Ruffman, from a family-owned business, expressed satisfaction with the recognition of the illegality in the implementation of the tariffs. Lawyers, however, warn that the measure does not apply to all surcharges, such as those imposed on Brazil and India.
Conflicting Arguments: National Emergency vs. Hidden Tax
The judges also rejected the government’s justification that Trump’s tariffs were necessary to address “national emergencies“. Arguments such as trade deficits or the fentanyl crisis were dismissed.
“Once again, a court has ruled that the president cannot invent a false economic emergency to justify billions in tariffs”, declared New York Attorney General Letitia James. She characterized the tariffs as “a tax on Americans“, which raises costs, generates inflation, and causes job loss.
Government Defends Measure as Pillar of Foreign Policy
Hours before the decision, members of the Trump administration defended the measure. They warned that overturning the tariffs would cause “dangerous diplomatic embarrassment” and weaken the U.S. position in trade negotiations. Treasury Secretary Scott Bessent stated that it would undermine the country’s international credibility.
After the decision, Trump declared that ending the tariffs would be a “total disaster”. The situation is leading affected countries to reassess their positions. China may reconsider concessions, while European nations may question the ratification process of their trade agreements with the U.S. The outcome of this standoff will define not only American trade policy but also the balance of the global economy.
