An unexpected bug in the Nubank system caused a stir among digi bank customers, according to hardware website. Between Thursday night and early Friday morning (8), a glitch allowed account holders to withdraw amounts exceeding the limits available in their accounts, directly at Banco24Horas ATMs. Users reported withdrawals of up to R$ 4,000, even without the corresponding credit. On social media, it didn’t take long for videos and comments celebrating the unexpected “bonus” to appear, while lawyers and specialists pointed out the legal consequences.
Illegal Withdrawals And Risk Of Imprisonment
A glitch in Nubank quickly raised alarms among legal professionals. According to Article 155 of the Penal Code, withdrawing money without authorization or without available credit can be considered theft. According to lawyer Miguel Pereira Neto, the bank has a responsibility to identify the customers who made these illegal withdrawals and initiate the process of returning the money. Those who do not return the funds may face serious consequences, with sentences of up to 4 years in prison.
Lawyer Beatriz Alaia Colin explains that, in many cases, there may be a less drastic solution: a non-prosecution agreement with the Public Prosecutor’s Office. She emphasizes that customers who acknowledge the error and commit to returning the funds can avoid a full judicial process. However, the final decision depends on the authorities and Nubank itself, which is still evaluating the measures to be taken.

The Banco24Horas, responsible for the infrastructure of the ATMs, stated that it only carries out transactions authorized by partner financial institutions, exempting itself from any responsibility for the glitch.
