Multinational Honda Is Not at All Satisfied with the Shameless Copy of the Biz 125 Made by Shineray from Brazil
The Chinese industry still hasn’t abandoned some old habits. Shineray from Brazil, a company constantly expanding in the Brazilian market, had a ruling issued, in the 2nd instance in the São Paulo Court, suspending the production, sale, exhibition, distribution, promotion, and advertisement of the Shineray Ray 50 model, after the multinational Honda filed a lawsuit claiming a blatant copy of the Biz 125, since the vehicle has the same features as the model manufactured and patented by the Japanese automaker.
No final judgment has yet been made in the action initiated last June. The Chinese automaker’s claim that “the Ray 50 and the Biz 125 are different products and have a sufficiently distinct appearance, so they can coexist in the market” was not convincing.
The lawyers for Shineray from Brazil argued that only an expert can confirm if there is a copy of Honda’s model, but the case rapporteur in the 2nd instance agreed with the Japanese automaker’s argument that the similarity between them is perceptible to an ordinary citizen, which would be enough to justify the suspension of sales until the final decision.

Shineray Was Sued in 2017 by the Japanese Automaker for the Same Reason!
This is not the first time that the Chinese automaker has been sued by Honda! In 2017, Shineray was convicted in another action from Honda related to copies of two motorcycles. At that time, the Chinese automaker was prohibited from selling the Max 150 and Explorer 150 models, considered reproductions of the CG 150 Titan and NXR 150 Bros.
Honda filed a lawsuit against Shineray’s representative in Brazil, BCI Brasil China Importadora e Distribuidora, in 2013. Despite the lawsuit, the Chinese automaker continued selling shamelessly.
At the time, the court declared a trivial value for the ‘crime’ committed by the Chinese automaker. Shineray was sentenced to pay only 63 thousand reais to Honda – which claimed to have suffered millions in damages exceeding R$ 130 million since 2011, when the Chinese motorcycles arrived in the Brazilian market.
In Brazil, Honda holds multiple patents, all registered with the competent government agency, including the industrial design of motorcycles and their parts. The manufacturing, advertising, offering, assembling, distributing, and marketing of products that violate these Industrial Design patents constitutes a serious infringement of the current intellectual property legislation.
The company is committed to protecting and enforcing its rights, taking, when necessary, appropriate legal measures against companies or individuals that violate the law and harm the brand and its consumers.”
