Executive secretary of the Ministry of Finance, Ana Paula Vescovi, communicated that the government is close to closing an agreement with Petrobras regarding the onerous assignment. This assignment is a contract agreed in 2010, in which the government assigned a part of the pre-salt area to Petrobras, which has the right to explore 5 billion barrels of oil. Due to the discovery of a larger volume of oil in the area, the government will sell this surplus. She also highlighted that the agreement will not depend only on the government and considered that a bill allowing the negotiation of the pre-salt onerous assignment has already been approved in the Chamber of Deputies and is awaiting consideration by the Senate.
It is already known what are the contractual difficulties of clarifying some clauses, where studies already occur within the TCU. After approval of the project at the congress, there will be conditions to prepare the public notice and the necessary adjustments to the contract. Technical and legal conflicts for the changes in the agreement took two years. To discuss the measures, the government set up a committee, with the participation of Petrobras and the Federal Court of Auditors – which analyzes the terms of the bidding notice for the excess in the area of transfer of rights.

As this surplus belongs to the union, care is taken to preserve Petrobras' right, to generate competition with the process, where this bidding will be important to reactivate investments in the oil sector.
Other measures adopted by the government will also reactivate the sector by allowing more security for investors and predictability such as the prior announcement of the rounds of the National Petroleum Agency (ANP).
According to the Minister of Planning Esteves Colnago, it is necessary to move forward on the issue of assignment in order to have “a legal framework that provides comfort to Technicians” enabling the signing of the term with Petrobras.
