Petrobras is being sued by the Federal Public Ministry (MPF) of Rio de Janeiro; the public civil action requests the partial shutdown of the Reduc refinery in Duque de Caxias (RJ) until there is a regularization of effluent emissions in the Iguaçu River and Guanabara Bay, the agency reported in a statement. Also defendants in the lawsuit, which aims to ensure the fulfillment of socio-environmental obligations, are the State Environmental Institute (Inea) and the State of Rio de Janeiro, the MPF stated.

In the lawsuit filed by the MPF, it requests the reduction of effluent discharge and the adjustment of the production activity within 30 days, in addition to requesting the adoption of an emergency plan to comply with various actions that the company should have adopted in the adjustment of conduct term (TAC) it signed with the Public Authority in 2011.
The TAC ended in 2017 without the fulfillment of measures that the MPF considers essential for effective environmental protection.
According to the MPF, the company’s signing of agreements with INEA and the State of Rio de Janeiro has been used to delay compliance with obligations by the company.
“It is noted that the indefinite postponement of compliance with essential obligations ends up legitimizing the widespread violation of constitutional environmental principles and all related legislation”, said Federal Prosecutor Julio José Araujo Junior, in a statement this Thursday, 19.
Petrobras must repair the damage caused to the environment and public health through investments in socio-environmental projects amounting to R$ 50 million, to be established jointly with the local population, with mandatory participation from the MPF.
Moreover, INEA and the State must repair the damage caused by negligence in oversight, through funding for the implementation of projects aimed at the health treatment of affected populations. Additionally, all three defendants must compensate for the collective moral damages caused to the population, in conjunction with INEA and the State of Rio de Janeiro, in the amount of R$ 40 million.
The agency’s investigation pointed out problems in the licensing of the refinery and the constant discharge of toxic substances into Guanabara Bay and its adjacent water bodies, with severe impacts on local biodiversity.
