Civil Action Points Out Fare Injustice on the Via Dutra and Wants to Paralyze Structures on All Federal Highways Until the Progressive Benefit Works.
A judicial decision can change the routine, and the wallet, of thousands of drivers who travel on federal highways, especially on the Via Dutra. The Federal Public Ministry (MPF) filed a Civil Action this Thursday (11), requesting the immediate suspension of all toll charges in the Free Flow system.
The measure aims to pressure the Union and the National Land Transport Agency (ANTT) to implement the Frequent User Discount (DUF), a mechanism that reduces the fare for those who use the highway repeatedly in the same month.
Why Can the Charges Stop?
The main argument from the MPF is equality. The Free Flow system began operating last Saturday (6) with structures between São Paulo, Guarulhos, and Arujá, but without offering the progressive discount that has existed at conventional toll plazas for 30 years.

For the agency, charging the full amount from those who use the road for work or study daily violates the constitution and penalizes the local population.
“The local user from Guarulhos… bears 100% of the fare on all monthly passages, including during the time slots when the fare is artificially raised”, stated Federal Prosecutor Guilherme Rocha Göpfert, the author of the action.
The Myth of “Technical Incompatibility”
The concessionaire and the ANTT claimed that it would not be technically possible to apply the discount in the automatic system now. The MPF, however, strongly rebutted this justification.
According to the action, the refusal to grant the discount is not technical but rather a “political choice of fare exclusion”. The prosecutor stresses that other state models of electronic tolls already successfully apply similar discounts, proving that the technology exists and is feasible.
What Is at Stake for the Driver?
If the injunction is accepted by the Federal Court:
- Suspension: Charges at the Free Flow structures may be halted.
- Conditional Resumption: Charging would only resume when the system of progressive discounts is regulated and operational.
- Scope: Although the initial focus is on the Dutra, the decision should create jurisprudence for all federal highways with this model.
This action seeks to ensure “fare justice”, preventing residents of densely urban areas, such as Guarulhos, from having their income compromised by full daily fares.
