Chamber of Deputies Approves Super Salaries Above the Constitutional Ceiling, With Billionaire Fiscal Impact and Criticism of Administrative Reform.

The Chamber of Deputies approved, at the beginning of the legislative work of 2026, a project that restructures the careers of its servers and authorizes payments above the constitutional ceiling, opening space for super salaries that can reach around R$ 77 thousand monthly.

The measure, voted on in Brasília, was conducted by the Board of Directors, approved in plenary in an expedited manner and justified as a form of administrative modernization, but it is expected to cause a billionaire fiscal impact exceeding R$ 1 billion and reignite the debate on administrative reform in the country.

In addition to the Chamber, lawmakers also approved, in the same session, a new career plan for Senate staff, expanding the scope of the decision.

The proposals now go for the sanction of President Luiz Inácio Lula da Silva, while criticism intensifies both inside and outside Congress.

Super Salaries Above the Constitutional Ceiling Enter the Center of Debate

In practice, the restructuring of the legislative career allows servers in senior positions to receive amounts exceeding the constitutional ceiling, currently set at R$ 46,366.19.

The combination of base salary, bonuses, and additional benefits — known as “add-ons” — can double compensation in certain cases.

According to the Chamber’s leadership, only 72 servers hold strategic functions and would be eligible to receive above the ceiling.

Even so, the adopted model raises questions about the coherence of the fiscal austerity discourse advocated by Congress in relation to the Executive.

Changes in Bonuses Increase the Fiscal Impact

One of the central points of the project is the extinction of the Representation Bonus, replaced by the Performance and Strategic Alignment Bonus (GDAE).

This new bonus can vary between 40% and 100% of the highest base salary of a legislative analyst and technician.

In addition, the text redefines the calculation of the Legislative Activity Bonus, updates the Specialization Additional, and promotes a review of the salary tables for the entire career.

These changes, when added together, significantly increase the fiscal impact, even if the resources come from the budget of the Legislative itself.

Compensatory Leave and Loopholes in the Constitutional Ceiling

Another sensitive point is the creation of compensatory leave for servers in commissioned positions of greater complexity.

The benefit grants one day off for every three days worked, with the possibility of conversion into financial compensation.

For critics, this mechanism works as a shortcut to circumvent the constitutional ceiling, weakening one of the main tools for controlling public spending on personnel. 

Defense of the Chamber and Alignment with Administrative Reform

Reporter of the proposal, Deputy Alberto Fraga (PL-DF) stated that the text did not originate from individual lawmakers, but from the Board of Directors.

“The project was not made by deputies; it was made by the Board of Directors. What we ask is to remove this constraint from the law so that the financial advantages of the servers can be decided by the Board,” he declared.

Meanwhile, the President of the Chamber, Hugo Motta (Republicanos-PB), maintained that the change has a broad vision and aligns with the administrative reform.

“We are looking at the Chamber as a whole, in a macro way,” he stated, emphasizing that the proposal complements salary adjustments already planned for various categories within the House.

Criticism from the Right and Left of the Chamber of Deputies

Despite the official discourse, the approval of super salaries generated a strong reaction in the plenary. Deputies from PSol and Novo criticized both the relaxation of the constitutional ceiling and the additional cost to public coffers. 

“Parliament ends up fueling its own unpopularity by not confronting its own interests,” said Deputy Chico Alencar (PSol-RJ).

Kim Kataguiri (União-SP) stated: “Instead of discussing spending cuts and ending super salaries, we are increasing expenses and creating new costs.”

Deputy Pedro Paulo (PSD-RJ), reporter of the administrative reform proposal, also voted against it and warned about the creation of new add-ons that, according to him, contradict the principles of the reform itself. 

Experts Warn of Cascade Effect in Public Service 

For analysts, the greatest risk lies not only in the immediate value. According to Bruno Perri, Chief Economist at Forum Investimentos, the issue resides in the consequences of the decision. “This R$ 1 billion can be absorbed by the budgets of the Legislative Houses.

The problem is in the cascade effect,” he stated.

Fernando Benavenuto, from Anvex Capital, reinforces the concern.

“When the constitutional ceiling becomes an exception, it ceases to be a rule. This weakens the control of personnel expenses and amplifies the fiscal impact in the medium and long term,” he assessed.

Pressure on Public Accounts and the Future of Administrative Reform

Although the resources come from the budget of Congress, the decision occurs at a moment of fiscal fragility and pressures the debate on responsibility with public spending.

For specialists, the super salaries approved by the Chamber of Deputies may serve as a reference for other careers, increasing costs and hindering real advancements in administrative reform.

Thus, the theme remains at the center of the political and economic agenda, with the potential to influence not only the budget but also the credibility of the fiscal discourse of the Legislative itself.
