The Mandatory Modernization of Companies for the New Bidding Law
With the imminent entry into force of Federal Law 14.133 on December 31, 2023, companies need to adapt to comply with the new rules. Lawyer Marcelo Palavéri, specialist in Municipal Law, has been a prominent figure in clarifying these legal changes, offering lectures, training and a new course aimed specifically at micro and small companies.
A New Era for Tenders
Law 14.133/21 promises to revolutionize the bidding process, providing greater speed and efficiency in the acquisition or contracting of goods and services. Through mechanisms designed to speed up the entire procedure, the new law also aims to improve transparency for society.
The changes will affect the federal, state, district and municipal public administrations, in addition to all direct administration entities. Palavéri believes that the biggest transformation promoted by law 14.133/21 will be in governance. “This legislative innovation raises the standards of control and security, requires planning and, as a result, will promote greater efficiency in public procurement”, comments Palavéri, also president of the São Paulo Institute of Municipal Management (IPGM).
Training: A Bridge to the Future of Procurement
Aiming to prepare micro and small companies to deal with the new requirements, Palavéri developed a course with a workload of twelve technical hours. The course consists of expository content in videos and support material for reading and complementing the study, including the in-company option, adapted to the specific needs of the company.
The course program is broad and detailed, covering topics such as: bidding concept; validity of Law 14.133/21; bidding structure according to the new Law; the position of micro and small businesses in Law 14.133/21; in-depth study of the modalities of the trading session and competition; price registration system; preparation of proposals and qualification in bids; the dynamics of the trial session and administrative appeals in Law 14.133/21 bids; and foundations of administrative contracts.
According to Palavéri, author of books on the new Law 14.133/21, these changes have been debated for almost two decades and will bring greater stability to the relationship between suppliers and the public sector. The expert believes that the changes can promote greater legal certainty, strengthen partnerships and attract more people interested in doing business with the public sector. “This should improve the process of providing continuous services, such as medication, cleaning, garbage collection, school meals, among others”, concludes the lawyer and president of the IPGM.
