ANP Holds Public Hearing to Discuss Access to LNG Terminals and Enhance Natural Gas Sector Regulations, Strengthening Transparency and Competition in the Brazilian Market
The Brazilian natural gas sector is in a decisive phase for strengthening competition and energy security, according to a report published.
On October 14th, the National Agency of Petroleum, Natural Gas and Biofuels (ANP) held a public hearing focused on discussing negotiated and non-discriminatory access for third parties to Liquefied Natural Gas (LNG) terminals.
The meeting, which also addressed conflict resolution in essential infrastructures, is part of the implementation of the New Gas Law (Law No. 14.134/2021), a regulatory framework aimed at modernizing the segment and attracting new investments.

Expanding Competition and Regulated Access to LNG Terminals
The debate proposed by ANP aims to define clear access rules for LNG terminals, an initial step in the regulatory process for essential infrastructures in the natural gas sector.
Article 28 of the New Gas Law establishes the right of third-party use of these structures, ensuring a more competitive environment.
During the hearing, ANP’s Superintendent of Infrastructure and Movement, Thiago Campos, emphasized that dialogue is essential for the final text of the regulation to reflect the needs of the market and society.
The drafts presented were open for public consultation from August 11 to September 24, during which 433 contributions from 13 participants were received, including representatives from government and the private sector.
Regulation of Infrastructures and the Impact of Decree No. 12.153/2024
In addition to LNG terminals, ANP is working on regulating access to gas pipelines for production distribution and gas treatment or processing facilities.
The expectation is that the process will be concluded by May 2026, according to the adjusted timeline following the changes made by Decree No. 12.153/2024, which updated Decree No. 10.712/2021.
This expansion of the regulatory scope reflects the technical complexity of the structures and the Agency’s commitment to ensuring that the natural gas sector operates in an integrated, efficient, and safe manner.
The changes aim to create a more stable and predictable business environment, encouraging the participation of new economic agents and reducing entry barriers in the market.
Regulatory Impact Analysis and Societal Participation
The proposals discussed at the hearing are the result of the Regulatory Impact Analysis (AIR) Report, prepared by a Working Group composed of various technical areas of ANP.
The study identified the need to ensure equal conditions in the use of essential infrastructures of the natural gas sector, in order to avoid discriminatory practices and promote the rational use of available resources.
After consolidating the contributions, the drafts will be submitted for approval by the Agency’s collegiate board.
The process reflects a model of participatory governance, where transparency and dialogue with society are central pillars.
