Worker With Serious Illness Can Withdraw FGTS Directly Through Caixa’s App Without Going to Court, Speeding Up Access to Benefits.

The Severance Guarantee Fund (FGTS) was created in 1966 as a type of compulsory savings to protect workers in specific cases, such as unjust dismissal, retirement, or housing finance. Over the years, various situations have been added to the withdrawal hypotheses, including cases of serious illness.

Until recently, many workers facing health issues had to resort to the courts to obtain the release of FGTS. This was because Caixa Econômica, the fund’s operating agent, often required extensive proof or denied requests when the illness was not clearly described in the regulations.

Now, with the modernization of digital channels and a more objective interpretation of the law, withdrawal for serious illness can be requested directly through Caixa’s application, without the need for legal proceedings.

Which Illnesses Allow FGTS Withdrawal

According to Law No. 8,036/1990 and Decree No. 99,684/1990, it is possible to withdraw the FGTS balance from active and inactive accounts in cases of:

  • Cancer (malignant neoplasm);
  • HIV/AIDS;
  • Terminal illness, regardless of what it is;
  • Severe diseases listed in regulations and recognized by official medical examination.

Additionally, withdrawal is also allowed when the dependent of the worker — such as a spouse or child — is affected by these illnesses.

Previously, the lack of clarity regarding the required documents created obstacles and forced many to seek legal routes.

How the Direct Request Through Caixa’s App Works

Today, the worker can open the FGTS app and select the option for withdrawal due to serious illness. The process requires the digital submission of:

  • Personal documents;
  • Recent medical reports;
  • Reports or certificates proving the health condition;
  • Dependency declaration, in the case of illness of a family member.

After analysis, Caixa can release the withdrawal directly into the worker’s linked account. The advantage is the elimination of the need for legal action, making the process faster in a moment of extreme vulnerability.

The Impact of the Change for Millions of Brazilians

It is estimated that more than 500,000 people have already requested to withdraw FGTS due to serious illnesses in the last five years.

For families facing high costs with medications, treatments, and transportation, the possibility of immediate access to the fund represents essential financial relief.

Previously, legal proceedings could take months, even in urgent cases. Now, direct access via the app reduces bureaucracy and returns to the worker the right to use their own resources in a critical situation.

The Court Still Has a Role in Cases of Denial

Despite modernization, not all requests are immediately approved. When there are discrepancies in medical reports or doubts about the severity of the illness, Caixa may deny the request.

In these cases, the courts remain the path to guarantee the right.

What changes is that, in most clear cases, such as cancer or HIV, the app itself resolves the situation, avoiding unnecessary proceedings.

FGTS and the Expansion of Digital Channels

The expansion of access via the app is part of a broader strategy by Caixa, which has been digitizing FGTS.

Today, the worker can check their balance, simulate withdrawals, and even join options like Birthday Withdrawal directly on their phone.

This digital transformation has become even more important after the pandemic, when the government authorized emergency withdrawals and millions of Brazilians relied exclusively on online channels to receive the benefit.

FGTS as a Social Protection Network

More than just a guarantee fund, FGTS has established itself as a social protection network for Brazilian workers.

Withdrawing in cases of serious illness is an example of how the mechanism can be vital in times of need, functioning as a financial cushion to face unexpected expenses.

With simplified access, FGTS better fulfills its role of support in situations of fragility.

The withdrawal of FGTS for serious illness has ceased to be a bureaucratic and judicialized process to become an effective right, accessible with a few clicks on a cellphone.

For workers battling serious illnesses, this change represents not only access to money but also the dignity of facing treatment with fewer financial obstacles.

There will still be cases where the courts will be necessary, but the main pathway is now at hand — and this completely changes the experience for those who need the fund the most.
